《学生体质健康标准》实施办法与《高等教育法》冲突的法律问题

摘要：针对2002年教育部、国家体育总局联合下发的《学生体质健康标准》的实施办法与《高等教育法》发生冲突的事实，从确定冲突法律依据、冲突的原因、冲突可能产生的法律后果、冲突解决的办法等方面进行论述，指出《学生体质健康标准》不是《高等教育法》中规定的学生必须完成的课程，它是检验学生体质健康的方法与手段，《学生体质健康标准》的要求，不应当作为学生毕业的条件。教育部和体育总局联合下发的《学生体质健康标准》实施办法与法律规定不符。

A conflict between the methods for implementation of Student Physical Health Standard and the Law of Higher Education

Abstract:Aiming at the fact that there is a conflict between the stipulation on the methods for implementation of Student Physical Health Standard and the Law of Higher Education jointly issued by the Ministry of Education and National Sports Bureau General,the author expatiated on the determination of legal criteria,causes for the conflict and legal consequences possibly produced by the conflict,as well as methods for resolving the conflict,and pointed out that Student Physical Health Standard is not a course that must be fulfilled by students as stipulated in the Law of Higher Education, but the methods and means for checking up student’s physical health,and that failure to meet the Standard shall not be considered as a condition for students to graduate since the law has clear stipulations on the conditions for students to graduate. Therefore,the methods for implementation of the Standard jointly issued by the Ministry of Education and National Sports Bureau General are not in conformity with the provisions as stipulated in the Law.
