网络环境下体育明星隐私权的法律保护

摘要：网络环境下侵犯体育明星隐私权，显现出多发性、低成本及法律适用上的不确定性等特点。体育明星隐私权有其独特的特征、内容、限制。分析了网络上体育明星隐私侵权的构成要件、免责事由和法律责任。建议在民法典人格权法编中独立一节规定隐私权，明确规定隐私权及对其保护的方法；明确隐私保护立法的原则、目标及立法框架；明确网络隐私侵权案件的地域管辖。

Legal protection of sports star’s privacy right under network environment

Abstract: Violation of sports star’s privacy right under network environment presents such new characteristics as frequent occurrence, low cost, and uncertainty of legal applicability. Sports star’s privacy right has its own particular characteristics, contents and limitations. The author analyzed the major constitutive components, exemption matters and legal responsibilities with respect to sports star’s privacy right under network environment, and suggested that the followings should be specified in an independent chapter (Privacy Right) in the Personal Right Law of Civil Law: Privacy right and the methods for its protection should be clearly specified; the principle, objectives and legal frame of privacy protection legislation should be clearly defined; territorial jurisdiction in relation to privacy violation cases should be clearly defined.
