从国际体育仲裁院的裁决看兴奋剂争议中的严格责任问题

摘要：对体育运动中服用兴奋剂行为所适用的是严格责任，大多数情况下根本不考虑有关当事人的主观意向。举证责任一般由指控运动员服用兴奋剂的体育组织承担，服用兴奋剂的嫌疑运动员也可以提供减轻处罚的证据。

A discussion about the strict responsibility issue in stimulant disputes from the perspective of the verdicts of International Sports Arbitration Court

Abstract: What is applicable to the stimulant using behavior in sports is the strict responsibility. In most cases, the interested parties’ subjective intention is not considered at all. The burden of proof usually lies with the sports organization whose athlete(s) is/are accused for using a stimulant or stimulants, and the suspected athlete(s) may also provide the proof(s) to reduce the penalty.
